Texas v. Pennsylvania Amicus Brief (2020 Presidential Election)

Citizens United, Citizens United Foundation and The Presidential Coalition have filed an amicus brief with the U.S. Supreme Court urging the court to permit Texas to challenge the manner in which Pennsylvania, Michigan, Wisconsin and Georgia chose their Presidential Electors in the 2020 presidential election.  The brief explains why the Framers vested the exclusive authority in state legislatures for deciding the “manner” in which presidential electors are elected, and why it is important for the Supreme Court to enforce that authority against the Defendant states in light of their failures to follow the processes mandated by their respective legislatures.

Citizens United Commends Work of Election Integrity Project California, Inc.

Citizens United is pleased to commend the outstanding work of Election Integrity Project California, Inc. (EIPCa). 

Citizens United has often focused attention on California as a rogue state whose election laws inhibit free and fair elections, and in many respects invite outright election fraud. EIPCa, with its over 11,000 volunteers, has effectively fought to restore and defend the rights of California voters since 2010. EIPCa’s Observation Program has been an effective weapon and a driving force in vastly improving poll worker training, holding elections officials accountable, and educating California voters about their electoral process with the goal of ensuring that every lawfully cast vote is accurately counted.

For example, EIPCa’s 2017 lawsuit against California’s Secretary of State and Los Angeles County’s Registrar of Voters forced the state into compliance with federal mandates (NVRA) for voter roll maintenance. LA County alone was required to remove 1.5 million inactive (deceased or moved) voters from its rolls, and all 58 California counties were put on notice to follow suit in cleaning up their rolls.

The influence of EIPCa’s Election Integrity Project® is now being felt in Arizona, Nevada, and Arkansas as its affiliated organizations in those states work to bring greater election integrity to their own citizens.

Trump v. New York - Merits Amicus Brief (Illegal Immigration/Census)

In Trump v. New York, Citizens United, and its sister organizations Citizens United Foundation and The Presidential Coalition, urge the Supreme Court to overturn a three-judge District Court ruling enjoining the Secretary of Commerce and other government officials from following President Trump's directive to exclude illegal immigrants from the population base on which congressional reapportionment is to be made. Citizens United's main argument is that the Constitution vests Congress with broad discretion over lawmaking as it relates to conducting the Census and that the Census Act, in turn, delegates broad discretion to the President and the Executive Branch over how the Census is to be conducted. We contend that the District Court's injunction effectively usurps the President's statutory and constitutional authority by substituting the judges' policy preferences over those of the President.

Trump v. New York - Amicus Brief (Illegal Immigrants-Census)

On Friday, October 2, 2020, Citizens United, Citizens United Foundation and The Presidential Coalition, LLC filed an amicus brief with the U.S. Supreme Court supporting the Trump Administration’s request that the Court summarily reverse a decision of a three judge U.S. District Court panel from the Southern District of New York, which issued an injunction prohibiting Commerce Department officials from following a presidential memorandum directing the Department and U.S. Census Bureau provide the President with data that would allow the Administration to exclude illegal immigrants from the population counts on which congressional re-apportionment is made every ten years.  The brief contends that the plaintiffs – a concoction of Democrat-run states and pro-illegal immigration non-profit organizations – lack standing to challenge the President’s directive, and that the President’s directive is consistent with the Constitution’s mandate on counting the population of each states because illegal immigrants are not part of the “people of the several States” to whom congressional apportionment applies.  The Supreme Court has ordered expedited briefing in the case and a decision on whether to summarily reverse the District Court panel or set the case for full briefing and argument is expected in short order.

Today, Citizens United and Citizens United Foundation filed comments with the Federal Election Commission urging the Commission to revise its regulations governing transfers of funds from federal candidates to national political party committees in order to close the loophole exploited by former New York City Mayor Michael Bloomberg to funnel $18 million of his personal funds from his presidential campaign account to the Democratic National Committee.
